WESTFIELD EXTRA PASS - TERMS AND CONDITIONS FOR USE

1. MEANINGS AND INTRODUCTIONS
1.1. Please read these terms and conditions (the “Terms”) carefully as they affect your rights and liabilities.
1.2. Westfield Europe Limited (“Westfield”, “we”, “us” or “our”) is providing a Westfield London EXTRA pass promotion (the “Promotion”) with participating retailers from Westfield London shopping centre (the “Centre”). By participating in the Promotion, you (the “Participant”) are deemed to have accepted and agree to adhere to these Terms. Westfield reserves the right to amend these Terms from time to time.
1.3. The Promotion is open from 12:01AM BST 22 August 2023 to 11:59PM BST 31 October 2023.
1.4. The Promotion is open to all UK residents over 16 years of age.
1.5. The Promotion is for personal use. You must not auction, donate, offer for sale, or advertise the Promotion for sale via the internet or elsewhere without our prior written consent.
1.6. The Promotion is free to participate in.
1.7. The participating retailers at the Centre are:
1.7.1. City Bouldering;
1.7.2. Flipper’s Roller Boogie palace;
1.7.3. Java Whiskers; and
1.7.4. Sixes Social Cricket,
(together the “Participating Retailers”)
2. PROMOTION STICKERS
2.1. The Participant must register and sign-up to the Promotion directly via their Westfield account. We reserve the right to refuse individuals, companies or agencies to the Promotion who we suspect have breached, or intend to breach, these Terms.
2.2. To collect one (1) virtual sticker the Participant must:
2.2.1. spend £25 or more in a single transaction at a Participating Retailer; and
2.2.2. scan an in-situ QR code at the Participating Retailer.
2.3. The Participant may collect multiple stickers at Participating Retailers.
2.4. Once a Participant has collected a designated number of stickers, the Participant shall receive a single-use voucher (the “Voucher”) on the ‘Extra Pass platform’ in accordance with the following:
2.4.1. three (3) stickers = 10% discount Voucher
2.4.2. six (6) stickers = 20% discount Voucher
2.4.3. nine (9) stickers = 30% discount Voucher
2.5. Stickers are non-transferable.
2.6. Westfield does not guarantee the availability of the Promotion or Vouchers at any time.
2.7. Westfield reserves the right to withdraw, amend or cancel the Promotion at any time without prior notice.
3. REDEEMING VOUCHERS
3.1. On the day of your visit to the Centre you should check that the Participating Retailers are open.
3.2. The Vouchers can be redeemed at any of the Participating Retailers at the Centre.
3.3. To redeem a Voucher at a Participating Retailer, a Participant shall present and surrender the Voucher to a member of staff at the Participating Retailer. If the Voucher is valid the member of staff will apply the discount.
3.4. Vouchers are only valid once.
3.5. Multiple Vouchers cannot be used in the same transaction.
3.6. Multiple Vouchers can be used in the same visit to the Centre.
3.7. Vouchers will be null and void if any amendments are made to it.
3.8. The following exclusions apply to the Vouchers:
3.8.1. City bouldering – the Voucher cannot be used on kid’s fun wall parties;
3.8.2. Flipper’s roller boogie palace – the Voucher cannot be used during happy hour, in conjunction with any other promotion or offer, or on merchandise; and
3.8.3. Sixes social cricket – the Voucher cannot be used in conjunction with any other promotion or offer.
3.9. Vouchers may not be used when purchasing gift cards at any participating venue
3.10. The Vouchers expire at 11:59 BST 07 November 2023.
4. REPLACEMENT VOUCHERS
4.1. Westfield is not responsible for any lost, stolen or damaged single-use vouchers. Any replacement of lost, damaged or stolen single-use vouchers is at our sole discretion and we may charge an administration charge for the replacement.
5. HEALTH AND SAFETY
5.1. Westfield may carry out security searches from time to time to ensure the safety or all visitors and Participants agree to allow yourself and/or your belongings to be searched prior to admittance to the Centre in order to prevent offensive or dangerous weapons from being taken to the Centre.
5.2. Participants may not take any weapons, glass bottles, flammable liquids or any other item that Westfield in its sole discretion may consider is dangerous to the Centre.
6. LIMITATION OF LIABILITY
6.1. Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses. Participants waive all rights of whatsoever nature against Westfield and the Centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your participation in the Promotion and attendance at the Centre.
6.2. Westfield does not accept responsibility for (i) network, technical, computer, hardware or software failures or faults of any kind which may restrict or delay the purchase or delivery of items, or (ii) any act or default of any third party supplier which is outside of Westfield’s reasonable control.
6.3. Nothing in the Terms shall exclude or restrict Westfield’s or the Centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.
7. GENERAL
7.1. Participation in the Promotion does not confer any rights (by implication or otherwise) on the Participant to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Promotion or Westfield’s website.
7.2. We reserve the right to change the advertised dates and schedule of the Promotion without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may amend or remove parts of the Promotion if deemed faulty. These Terms set out your rights in this situation.
7.3. Save that any company in the Westfield group of companies, as well as the Centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
7.4. Nothing in these Terms affects any of your statutory rights which may not be legally excluded.
7.5. Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.
7.6. These Terms and the Promotion shall be governed by and interpreted in accordance with the laws of England and any disputes will be decided only by the English courts.
8. HOW WE USE YOUR PERSONAL DATA
8.1. By participating in the Promotion, the Participant is sending personal information to Westfield who will use this personal data in accordance with data protection laws. Further information on how personal data is used, and data protection rights are explained in Westfield’s Privacy Notice, available at https://uk.westfield.com/privacy. Westfield’s data protection team can be contacted at dpo@urw.com.
8.2. Where Participants have consented to receiving marketing materials from a Participating Retailer at the Promotion, the Participant understands that their personal data will be treated in accordance with the Participating Retailers privacy notice (not Westfield’s) and that it is the Participating Retailer who is responsible for ensuring that the Participant’s personal data is treated in accordance with data protection laws. Should the Participant have any queries or complaints in relation to a Participating Retailers treatment of their personal data, the Participant should refer that complaint directly to the Participating Retailer.
Westfield - EXTRA pass - Terms and Conditions EXTRA pass prize draw 2023
Entry Conditions
a) Entry to this prize draw can be made between 10:00am on 21 August 2023 and 11:59pm on 31 October 2023 via the Westfield Westfield London shopping centre.
b) To be eligible for entry into this prize draw entrants must:
a. be aged sixteen or over;
b. collect virtual sticker/s via the EXTRA pass platform at any of the following participating retailers at Westfield London shopping centre:
i. Sixes;
ii. City Bouldering;
iii. Java Whiskers; and
iv. Flipper's Roller Boogie Palace, (together the “Participating Retailers”), and
c. have a valid Westfield account.
c) One entry per virtual sticker collected via the EXTRA pass platform.
d) All entries must be received by 11:59pm GMT on 31 October 2023. Westfield Europe Limited (“Westfield”) cannot accept any liability for any entries which are late, lost, incomplete or rendered unrecognisable.
e) Employees of Westfield, their families, dependants and agents and any other person connected with the prize draw may not enter.
f) Westfield reserves the right to refuse to accept any entry and/or to select a winning entry at Westfield’s absolute discretion. Entries are subject to verification. Incomplete, void, bulk, automated and third party entries (including “voting exchange”) will be disqualified. Westfield reserves the right to terminate, amend or temporarily suspend this prize draw and amend these terms and conditions at any time, in its absolute discretion, without prior notice, if Westfield considers it necessary to do so.
g) Failure to comply with these terms and conditions will automatically render a prize draw entry void. These terms and conditions shall be governed and construed in accordance with English law. Entry to the prize draw signifies acceptance of these terms and conditions.
h) The prize draw is in no way sponsored, endorsed or administered by, or associated with the Participating Retailers. Entrants understand and agree that they are providing their information to Westfield and not to the Participating Retailers. By entering this prize draw, each entrant releases each of the Participating Retailers from any action or claim arising out of the prize draw. Any questions, comments or complaints regarding this prize draw must be directed to Westfield, not the Participating Retailers.
i) Westfield, its agents and commercial partners exclude to the fullest extent permitted by law any liability for (a) any loss or damage arising from or in connection with this prize draw or with the acceptance or possession of any prizes (other than those warranties or conditions implied by statute and which cannot be excluded); (b) the accuracy or otherwise of any description or illustration of any prizes; (c) any loss, damage, non-availability or late receipt of any prizes or any communication associated with this prize draw and (d) any fees, charges, taxes or other costs which the winner may be required to pay in connection with any prize. Westfield further disclaims liability for any injury or damage suffered by the entrant or any other person relating to or resulting from participation in or downloading any materials in connection with this prize draw. Westfield will not be liable for failure or delay in delivery or performance of their obligations under these terms and conditions in the event of any unforeseen cause beyond its control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure. Westfield is not responsible for any third party acts or omissions for issues of any nature encountered by entrants associated with their entry into this prize draw.
Prize
a) One (1) entry shall be selected at random using a random value generator formula from the eligible entries after the prize draw has closed. The winner shall receive a Westfield London shopping centre gift card with a load value of one thousand pounds (£1000). No expenses incurred in connection with the prize draw will be paid other than as set out in these terms and conditions.
b) The gift card is valid for one (1) year, must be redeemed at Westfield London shopping centre and cannot be transferred to another shopping centre.
c) The selection is final and no correspondence will be entered into.
d) There are no cash alternatives: the prize must be accepted as offered, is non transferable and subject to availability. Westfield reserves the right to substitute a prize or part thereof with a prize of equal or higher value in the event of unforeseen circumstances and/or withdraw or amend the promotion at any time without prior notice.
Notification
a) The winner will be notified by email from a urw.com email address on or around 31 October 2023. If the winner does not respond within three (3) business days of Westfield’s communication, Westfield reserves the right to select an alternative entrant to receive the prize.
b) The winner is responsible for collecting the gift card from the guest services desk on level 0 at Westfield London shopping centre within fourteen (14) days of being notified of winning the prize draw.
c) The winner must bring: (i) a form of valid photograph ID which matches the personal details on their Westfield account; and (ii) a copy of the message stating they have won the prize draw.
Publicity
The winner agrees to participate in any and all advertising, promotion or other commercial activities relating to the prize draw and consents and agrees that their photograph, image, likeness and voice may be used by Westfield in all related promotional activity without any rights of prior approval or inspection.
How we use personal data
By submitting an entry, entrants are sending their personal information to Westfield who will use this personal data in accordance with data protection laws. Where entrants have consented to receiving marketing materials from sponsors of prize draws, entrants understand that their personal data will be treated in accordance with the sponsor’s privacy notice (not Westfield’s) and that it is the sponsor who is responsible for ensuring that the entrant’s personal data is treated in accordance with data protection laws. Should entrants have any queries or complaints in relation to a sponsor’s treatment of their personal data, the entrant should refer that complaint directly to the sponsor.
