Westfield London & Stratford City Gift with Purchase at Hugo

 

The Promotion

 

1. Westfield Club members who spend £250 in-store at HUGO BOSS at Westfield London or Westfield Stratford City can redeem an exclusive gift with purchase (the “Offer”)

    

2. The Offer is subject to these terms and conditions. Redeeming the Offer signifies acceptance of these terms and conditions.

    

3. The Offer is open to Westfield Club members and valid until 31 December 2024;

    

4. The Offer is valid for one purchase per person in the Hugo Store White City or Hugo Stratford City, while stocks last.

    

5. The Offer can only be redeemed by the customer personally at the time of qualifying purchase. Customers must show the reward in the Westfield app to the Retailer. The Offer is not transferable, refundable, or exchangeable for cash, any other payment method or any other item.

    

6. The Offer cannot be combined with other offers, promotions, or discounts.

    

7. “Click and Collect” and “Order from Store” orders, watches, eyewear, fragrance, women jewellery, and writing instruments purchases are excluded from this Offer.

    

8. HUGO BOSS reserve the right to terminate the Promotion for cause, whole or in part, at any time under consideration of the opposing interests.

    

9. HUGO BOSS UK Limited (the “Retailer”) is the organiser and promoter of the Promotion.

 

General

 

1. Westfield Europe Limited (‘Westfield’) takes no responsibility for delivery of the Offer by the Retailer.

    

2. Westfield reserves the right to change the Offer and schedule of the Offer without notice or liability at Westfield’s absolute discretion, where it is necessary to do so for reasons beyond our reasonable control.Westfield may amend or remove parts of the Offer if deemed faulty.These terms set out your rights in this situation.

    

3. Westfield reserves the right to (i) change these terms from time to time and (ii) cancel, amend or temporarily suspend the Offer at any time in its absolute discretion without prior notice.

    

4. Whilst Westfield makes every effort to monitor the experience fulfilled by the Retailer, any liability incurred by the visitor or the recipient caused by any Retailer negligence is the responsibility of the Retailer and not the responsibility of Westfield.Westfield shall not be liable for the death or personal injury of the customer, recipient or third party while undertaking any treatment or activity provided by a Retailer or a relevant supplier. Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims.

    

5. Save that any company in the Westfield group of companies, as well as the Centre owners, may benefit from these terms, no person who is not a party to these terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

    

6. Nothing in these terms and conditions affects your statutory rights. These terms and conditions are subject to the law of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English courts.

    

7. By redeeming the Offer, visitors are sharing their personal information with Westfield who will use this personal data in accordance with data protection laws. There are no cash alternatives. The Offer must be accepted as offered, are non-transferable and subject to availability.

 

The Promotion is not open to employees of Westfield or Bindas Eatery and its associated companies or group companies or their immediate families, households, or anyone professionally associated with the Promotion.

                                             

Further Terms

 

Westfield reserves the right to modify the terms of this Promotion at its discretion and to extend, modify, amend, postpone or cancel the Promotion at any time without notice.

 

Bindas Eatery and Westfield may, in its absolute discretion, refuse to provide the Offer to a customer who, in either Westfield or Bindas Eatery’s view has acted fraudulently or not complied with these Terms and Conditions.

 

Bindas Eatery and/or Westfield’s decision in relation to the Offer is final and no correspondence will be entered into.

 

This Promotion cannot be used in conjunction with any other offer, gift, discount or promotion and cannot be applied retrospectively. 

 

Westfield accepts no responsibility or liability for delivery or enjoyment of the Offer or any other costs or expenses that may be incurred by the accepting the Offer or relating to the enjoyment of the Offer.

 

Limitation of Liability

 

The Promoter, its agents and commercial partners exclude to the fullest extent permitted by law any liability for (a) any loss or damage arising from or in connection with this Promotion or with the acceptance or possession of any items (other than those warranties or conditions implied by statute and which cannot be excluded); (b) the accuracy or otherwise of any description or illustration of the Promotion; (c) any loss, damage, non-availability or late receipt of the Offer; and (d) any fees, charges, taxes or other costs which the customers may be required to pay in connection with the Promotion.

 

The Promoter further disclaims liability for any injury or damage suffered by the customer or any other person relating to or resulting from participation in or downloading any materials in connection with the Promotion. The Promoter will not be liable for failure or delay in delivery or performance of their obligations under these terms and conditions in the event of any unforeseen cause beyond its control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure. The Promoter is not responsible for any third party acts or omissions for issues of any nature encountered by customers associated with this Promotion. 

 

These Terms and Conditions are governed and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By participating in this Promotion, customers are sending their personal information to Westfield who will use this personal data in accordance with data protection laws. Where customers have consented to receiving marketing materials from participating retailers to this Promotion, customers understand that their personal data will be treated in accordance with the participating retailer’s privacy notice (not Westfield’s) and that it is the sponsor who is responsible for ensuring that the customers’ personal data is treated in accordance with data protection laws.  Should customers have any queries or complaints in relation to a sponsor’s treatment of their personal data, the customer should refer that complaint directly to the participating retailer.
