SPECIAL TERMS AND CONDITIONS OF USE OF SMART PARKING

These special terms and conditions (the "Special Terms") govern the digital use of the Express Parking [AD1]service offered in the French shopping centers Westfield Parly 2 and Westfield Velizy 2 (the "Center(s)") by (i) Unibail Management, a simplified joint-stock company with a capital of €20,000,000 whose registered office is located at 7 place du Chancelier Adenauer 75016 Paris,  France, registered with the Paris Trade and Companies Register under number 414 878 389 and (ii) Espace Expansion, a simplified joint-stock company with a capital of €464,910 whose registered office is located at 7 place du Chancelier Adenauer, registered with the Paris Trade and Companies Register under number 323 998 690 ("URW",  "We", "Us", "Our").[AD2]

The Express Parking is a paid parking area located within the parking of the Centres.

Smart Parking is the digital service that allows members of Our Loyalty Program to book their parking space in the Express Parking, pay for it online or subscribe to automatic payment (the "Smart Parking").

These Special Terms and Conditions supplement SECTION B – SPECIFIC TERMS AND CONDITIONS APPLICABLE TO SHOPPING CENTRES IN THE EU of the Website, App and Loyalty Programme Terms of Use, which remain fully applicable and deemed to be incorporated herein.

By ticking the box provided for this purpose, you accept the Special Terms and Conditions. If, for any reason, you do not agree with the Special Terms and Conditions, please do not use Smart Parking.

  1. SUBSCRIPTION

    Smart Parking is reserved for members of Our Loyalty Program, if you are not a member, you can become one by creating an account on Our https://www.westfield.com/ website  or on Our mobile application "Westfield" (your "Account").

    To access Smart Parking, you must:

    You will then be redirected to the online page dedicated to Smart Parking, which allows you to continue your choice ("the Space").

  2. DESCRIPTION
    • 2.1. Pay online for your parking space in the Express Parking

    Parking spaces located in the Centres' Express Parking can be paid for directly in the Space. To use this feature:

    The summary of your payment is sent by email to the email linked to your Account and is also available on the Space.

    Please note that for this feature, your license plate is read by the license plate detection system located at the barriers placed at the entrance and exit of the Express Parking, which allows us to calculate your parking time and calculate the rate applicable to your stay according to the pricing in force in the Parking concerned.

    • 2.2. Book and pay online for your stay in the Express Parking

    To reserve your parking space in the Express Parking via the Space, simply enter the date and desired time slot of your parking place (start time and end time) and the number plate of the vehicle concerned by your reservation.

    Please note that a minimum of 30 minutes is required for online booking.

    The confirmation of your booking and its payment is sent by email to the email linked to your Account and is also available on the Space. It includes the summary of your reservation, a map of the parking allowing you to identify the Express Parking in which you will be able to park and a QR Code that can be scanned to activate the parking barriers in the event of a malfunction of the number plate detection system.

    Up to the parking start time mentioned in your reservation, you have the right to cancel your reservation. To do this, you must go to the "Express Parking" section of the Centre, select the feature for reserving a space within the Express Parking, click on "My reservations" on the Space and click on the cancellation button for your current reservation. You will be reimbursed the full amount of the reservation to the credit card used for payment in accordance with the deadlines usually practiced by your bank.

    To make the most of your reservation, simply go to the parking of the Centre selected at the arrival time indicated in the confirmation of your reservation and follow the signs to access the Express Parking. Your license plate will be read by the license plate detection system located at the barriers placed at the entrance to the Express Parking, access will be allowed and you will be able to park at the place of your choice.

    At the end of your reservation, take the exit lane of the Express Parking. At the barriers, your license plate will be read by the license plate detection system:

     

     

     

    The "Smart Parker" subscription allows you to be automatically debited from your bank card for the amount of each of your parking spaces within the Express Parking without any additional action on your part.

    Regardless of which Centre is selected to access this feature, the subscription is free and is valid for the parkings of both Centres (Westfield Parly 2 and Westfield Velizy 2).

    To benefit from this feature, you must register as a "Smart Parker" on the Space. To do this, you are asked to:

    You will receive an email confirming that your "Smart Parker" subscription has been taken into account. Your subscription will be effective immediately.

    To take advantage of it, simply go to the Express Parking of these Centers. 

    Your license plate will be read by the license plate detection system located at the entrance of the Express Parking and We will record your arrival time. The gates will open and you can park.

    At the end of your stay, your exit time will be taken into account by the license plate detection system located at the exit barriers and the duration of your stay will be automatically calculated.

    You will then be debited the amount corresponding to this duration on the basis of the rates in force in the Centres' parking.

    The summary of your payment is sent by email to the email linked to your Account and is also available on the Space.

    As long as you do not terminate your subscription, it will be valid and you will be automatically debited for each parking stay in the Parking Express of the Centres. 

    You can cancel your subscription at any time by clicking on the button provided for this purpose in the Space in the "My Smart Parker account" section. Your subscription will end after one (1) month.

  3. MANAGING YOUR SPACE

    The Space is accessible:

     

    In the Space, you can modify or delete your information, access your current or past orders and reservations, modify or cancel an order in progress, obtain your invoices and manage your "Smart Parker" subscription (subscribe or terminate it).

  4. APPLICABLE RATES AND BILLING

    The applicable rates are those in force in the parking concerned.

    These rates are displayed at the parking reception and/or in the "Express Parking" section of each of the two Centres on our website https://www.westfield.com/ or on our mobile application "Westfield". 

    The price of your stay corresponds to the rate applied by the concerned Center for the duration of your parking. This price will also automatically take into account any discounts or benefits relating to parking granted to members of Our Loyalty Program by the concerned Center.

    The invoice is sent by email to the email linked to your Account and is also available on the Space. 

    We may terminate Smart Parking or any of its features if you fail to comply with your obligations and/or for reasons specific to us. Any booking in progress at the time the Smart Parking is terminated by us will be fully refunded.

  5. YOUR OBLIGATIONS

    Each user of the Smart Parking undertakes to:

    In the event of a breach of your obligations, We reserve the right to no longer make the Smart Parking available to you and/or to terminate your "Smart Parker" subscription. 

  6. INFORMATION – COMPLAINTS – ASSISTANCE

    For any request for assistance arising during your stay in one of our parkings, you can contact an operator using the terminal provided for this purpose.

    For any other request for information, complaint or assistance, we invite you to contact the concerned Centre.

  7. PERSONAL DATA

    We process your personal data when you access and use Smart Parking. This processing is necessary for the purposes of the performance of these Special Terms and Conditions (i.e. the contract).

    Your personal data is collected directly or indirectly from you when you fill in information about you on the Space or when you use the Smart Parking.

    This personal data corresponds to the number plates of the vehicles for which you wish to benefit from Smart Parking, details of your parking (Parking concerned, dates and times of booking, dates and times of arrival and exit from the Parking, amount excluding tax and including tax of the parking) as well as your credit card information.

    The recipients of your data are:

    Your data is stored for a period of 3 years after the last digital contact or use of Smart Parking.

    Please note that we do not have access to or process your credit card details. This data is processed by Worldline SA. This data is stored in an encrypted and secure manner in accordance with the regulations and recommendations applicable when you subscribe to the "Smart Parker" subscription insofar as this is necessary to set up the automatic payment of your parking space. Only the last 4 digits of your bank card will be visible in your Space.

    Your data is not transferred outside the European Economic Area.

    We have appointed a data protection officer who can be reached at the e-mail address data.protection@urw.com or by post at 7 place du Chancelier Adenauer, 75116 Paris, France.

    You have rights over your data. All of your rights and how you can exercise them are detailed in Our Privacy Policy available here.

    You can also modify the personal data entered when using the Smart Parking directly on the Space. 

  8. UPDATE OF SPECIAL CONDITIONS
  • Online payment for a parking space in the Centre's Express Parking;
  • The reservation of a parking space in the Centre's Express Parking and its payment online and in advance of your visit to the Centre;
  • The "Smart Parker" monthly subscription.
  • Log in to your Account.
  • access the Express Parking with your vehicle,
  • park in the place of your choice,
  • At the end of your stay, goto the Space to:
    • Enter your licence plate number.
    • Validate the summary showing your arrival time, your exit time and the amount for your parking.
    • Pay for your stay.
  • You then have a few minutes to leave the Express Parking.
  • Move your vehicle forward to the exit gates which will open automatically if the payment has been validated.
  • If no space is available, it will not be possible to continue your reservation.
  • If a place is available: a summary of your reservation request will be displayed, specifying the time slot and the price of your reservation. After checking that your booking request does not contain any errors, you must validate your booking and proceed to pay for it online.
  • If the time slot of your reservation has been respected, the barriers will open automatically. You can also scan the QR Code to open the barriers in case of a malfunction of the license plate detection system.
  • If your reservation was longer than the time slot you had booked, you will have to pay an additional amount calculated on the basis of the rates in force in the parking concerned. Payment can be made at the parking terminal provided for this purpose or in the Space.
  • If you park for a shorter period than the one you booked, there will be no prorated refund of the actual parking time.
  • If you have not cancelled your booking and decide not to use your parking space, we will not refund it.
    • 2.3. Become a "Smart Parker" subscriber
  • enter the license plate of the vehicle(s) for which you wish to subscribe,
  • check and validate your subscription summary,
  • fill in the information on your bank card that is necessary to allow the automatic payment of your parking lots.
  • -on Our https://www.westfield.com/ website or on Our mobile application "Westfield", under the heading "Le Parking Express" in the "services" section of each of the two Centres;
  • in the "My benefits and services" section accessible from your Account.
  • -not to use the Smart Parking for malicious and/or fraudulent purposes;
  • provide accurate information about himself or his reservations;
  • comply with the internal regulations of the Centres and parkings;
  • comply with the General Terms and Conditions and these Special Conditions;
  • pay the price of his stay.
  • Our staff authorised in order to carry out their missions;
  • Our subcontractor, Designa Digital Solutions GmbH, which operates the platform through which Smart Parking is offered;
  • your banking institution for the validation of the payment;
  • Worldline SA in its capacity as a Smart Parking payment provider;
  • any competent authority or legal entity to respond to legal or regulatory requests, injunctions, court orders, or legal process, if necessary to comply with applicable laws;
  • any assignee, where the personal data is part of the assignment or transfer of all or part of Our assets to another company;
  • Our insurers, lawyers or other external counsel, and courts to enforce Our rights and/or defend Us.

We reserve the right to modify or update the Special Terms at any time. You will be notified of any changes by the means We deem most appropriate (e-mail, notification, posting of the revised Special Terms via Smart Parking). If We make any changes and your consent is required in accordance with applicable law, We will seek your consent.
