Westfield Day’s Styling Sessions Terms and Conditions  – Westfield Stratford City

1. Please read these Terms and Conditions (the “Terms”) carefully as they affect your rights and liabilities under the law and set out the terms under which Stratford City Shopping Centre (No.2) Nominee A Limited and Stratford City Shopping Centre (No.2) Nominee B Limited acting as trustees for Stratford CityShopping Centre (No.1) Limited Partnership (the “Centre Owner”) of Westfield Stratford City Shopping Centre, Montifichet Road, London E20 1EJ (the “Centre”) and Westfield Europe Limited (“Westfield”) acting as an asset manager (together, “we” or “our”) make Westfield Days Styling Sessions (the Event) available for use.

    

2. By booking tickets for Westfield Days Styling Sessions (the “Ticket(s)”) you are deemed to have accepted and agree to adhere to these Terms. We reserve the rights to amend these Terms from time to time. 

   TICKETS AND ADMISSION

3. Tickets are available to book via Eventbrite website and subject to Eventbrite terms of services. By booking tickets you are deemed to have accepted and agree to adhere to such terms of service, in addition to these Terms.

    

4. One Ticket entitles the bearer to a 20-minute styling session (the “Session”) at Westfield Stratford City. The Ticket also entitles the bearer to receive a £15 Westfield Stratford City gift card.

    

5. Sessions are limited to the dates and times specified below.

    

6. Customers must arrive at least 10 minutes before the Session and provide confirmation of their booking to staff to enter the Session. Tickets are only valid for the time and date for which they were purchased. We reserve the right to refuse entry should a Ticket be used outside its valid time and date.

    

7. Only one adult (aged 18 years or over) shall be permitted to enter the Session per Ticket.

    

8. Customer must not auction, donate, offer for sale, loan or advertise the Tickets or sell via the internet or elsewhere.

    

9. All Ticket holders must adhere to the general rules displayed at the Event, and/or the relevant safety announcement or instructions from Staff while attending the Session.

    

10. A Ticket obtained in breach of these Terms, or which in our reasonable opinion is being used or is intended to be used in breach of these Terms, shall be void.  This may include you being refused entry, or your Ticket(s) being cancelled without notification. No compensation will be provided to you in such circumstances. 

     

11. Prices are stated in pounds sterling and inclusive of VAT. We reserve the right to change the price of the Tickets displayed at any time without notice.

     

12. Smoking (including the use of e-cigarettes and vaping), the consumption of alcohol and the use of professional photographic and video cameras are strictly prohibited at the Session.

     

13. We reserve the right to request Ticket holders to leave or refuse entry to Session and the Centre at any time and may take appropriate action to enforce this right. We may refuse any Ticket holder access to or may remove any Ticket holder from the Session or the Centre who: 

1. has been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;
2. has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;
3. has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages any part of our property at the Centre;
4. in the reasonable opinion of our staff is acting under the influence of alcohol or drugs; or
5. is not adhering to these Terms.

CANCELLATIONS OR RESCHEDULING

1. We reserve the right, in our absolute discretion, whether for safety reasons or otherwise:
   1. to reschedule a Session due to unforeseen circumstances outside of our control. In these circumstances, we shall use reasonable endeavours to notify you as soon as possible. In the event we have to cancel a Session, you shall be entitled to a full refund, but no other compensation shall be payable; or
   2. to close Styling Session during a Session or stop a Session due to unforeseen circumstances outside of our control. In these circumstances, we reserve the right not to issue refunds, but may do so in our sole discretion.

   LIMITATION OF LIABILITY

2. Westfield and the Centre Owner will not be held responsible for the loss or damage of or to any of your property or personal belongings during your Session.

    

3. Westfield and the Centre Owner shall not be liable for loss or damage of any kind whether direct or indirect, including but not limited to travel expenses, car parking fees or any other out of pocket expenses.

    

4. While Westfield and the Centre Owner make every effort to monitor performance of the services which are fulfilled by third party suppliers (“Suppliers”), any liability incurred by you which is caused by the acts or omission of the Suppliers is the responsibility of the Suppliers and not the responsibility of Westfield or the Centre Owner. For the avoidance of doubt, Westfield and the Centre Owner do not accept responsibility for: (i) network, computer, hardware or software failures of any kind which may restrict or delay the booking or delivery of Tickets; or (ii) any lost, stolen or damaged Ticket.

    

5. Other than for liability that cannot be excluded by law, neither the Centre Owner nor Westfield shall be liable for the death or personal injury which arises from or is caused by events outside of the Centre Owner’s or Westfield's reasonable control, including the acts or omissions of the Suppliers.

    

6. You waive all rights of whatsoever nature against Westfield and the Centre Owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your booking of a Ticket or your attendance at the Session which is caused by the acts or omissions of the Suppliers.

    

7. The Centre Owner or Westfield shall not be liable in any amount for failure to perform any obligation if such failure is caused by the occurrence of any unseen event beyond its reasonable control.

    

8. Except as otherwise stated, any liability we owe shall be limited to the price paid for the Ticket(s) purchased for the relevant Session in which the claim arises.

    

9. Nothing in these Terms affects any of your statutory rights which may not be legally excluded.

    

   GENERAL

10. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.  
11. Save that any company in the Westfield group of companies, as well as the Centre Owners, or Westfield may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. 
12. Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future. 
13. These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and any disputes will be decided only by the exclusive jurisdiction of the English courts.

    EVENT DETAILS

14. Subject to clause 14, the Event will take place on the 12^th, 13^th, 19^th and 20^th October from 11am to 6.30pm each day.
15. The Event will take place at Westfield Stratford City, Montifichet Road, London, E20 1EJ at a unit located on the booking confirmation.
16. Tickets are available to book via Eventbrite from the date advertised by Westfield. This is a paid, ticketed event, advance booking is required.

     

17. A Ticket to a Session will include:
    1. Entry to a Session;
    2. £15 Westfield Stratford City Gift Card;

    HOW WE USE YOUR PERSONAL DATA

18. By attending the Session, you may send personal data to Westfield who will use this personal data in accordance with applicable data protection laws and our privacy notice (which is available at https://uk.westfield.com/privacy). This privacy notice explains how Westfield processes your personal data, your rights in relation to that personal data, and how you can contact us. Ticket holders who wish to exercise their rights can do so by submitting a form at MyRights.As Westfield is a UK company, your personal data needs to be stored in or transferred to the UK or be accessed from the UK. 

 

Westfield Club Loyalty – Westfield Days Promotion Terms and Conditions

(the “Terms and Conditions”)

The Promotion - Westfield Days Passport 

Westfield Club Loyalty members can win a £10 Westfield Gift Card (the “Prize”) by successfully collecting three badges at Westfield Days (the “Event”) taking place at Westfield London and Westfield Stratford (“Westfield Shopping Centre”) between 12^th to the 13th of October 2024 and 19th to the 20th October (the “Event Period”).

By entering into the giveaway, customers expressly accept these Terms and Conditions.

Eligibility

To be eligible for the Prize, customers must be one of the first fifty (50) customers who:

1. Are a Westfield Club Loyalty member;

2. Attend the Event at either Westfield Shopping Centre in the UK;

3. Participate in at least three of the Event’s activations; and

4. Collect three (3) badges in the Westfield App;

The Prize is strictly limited to 50 Prizes per Westfield Shopping Centre, each day of the Event.

Badges must be collected on one Event day and cannot be carried over to the next Event day.

Badges must be collected at only one Westfield Shopping Centre and customers are only eligible to receive the Prize once throughout the Event Period.

Customers will be notified via the App and must redeem the Prize at the Event on the day they are notified. Customer must show the winning notification on their App to Event Staff.

There is no cash alternative for the Prize and Westfield reserves the right to substitute the Prize with a prize of equal or greater value.

The Promotion is not open to employees of Westfield and its associated companies or group companies or their immediate families, households, or anyone professionally associated with the Promotion or the Event.

Westfield may, in its absolute discretion, refuse to provide the Prize to a customer who, in Westfield’s view, has acted fraudulently or not complied with these Terms and Conditions.

Westfield reserves the right to modify the terms of this Promotion at its discretion and to extend, modify, postpone or cancel the Promotion at any time.

This Promotion cannot be used in conjunction with any other offer, gift or promotion and cannot be applied retrospectively. 

Westfield’s decision in relation to the Prize is final and no correspondence will be entered into.

Westfield accepts no responsibility or liability for enjoyment of the Prize or any other costs or expenses that may be incurred by the accepting the Prize or relating to the enjoyment of the Prize.

Limitation of Liability

The Promoter, its agents and commercial partners exclude to the fullest extent permitted by law any liability for (a) any loss or damage arising from or in connection with this Promotion or with the acceptance or possession of any items (other than those warranties or conditions implied by statute and which cannot be excluded); (b) the accuracy or otherwise of any description or illustration of the Promotion; (c) any loss, damage, non-availability or late receipt of the Prize; and (d) any fees, charges, taxes or other costs which the customers may be required to pay in connection with the Promotion.

The Promoter further disclaims liability for any injury or damage suffered by the customer or any other person relating to or resulting from participation in or downloading any materials in connection with the Promotion. The Promoter will not be liable for failure or delay in delivery or performance of their obligations under these terms and conditions in the event of any unforeseen cause beyond its control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure. The Promoter is not responsible for any third party acts or omissions for issues of any nature encountered by customers associated with this Promotion.

These Terms and Conditions are governed and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By participating in this Promotion, customers are sending their personal information to Westfield who will use this personal data in accordance with data protection laws. Further information on how personal data is used, and data protection rights are explained in Westfield’s Privacy Notice, available at https://uk.westfield.com/privacy. Where customers have consented to receiving marketing materials from sponsors of Promotions, customers understand that their personal data will be treated in accordance with the sponsor’s privacy notice (not Westfield’s) and that it is the sponsor who is responsible for ensuring that the customers’ personal data is treated in accordance with data protection laws.  Should customers have any queries or complaints in relation to a sponsor’s treatment of their personal data, the customer should refer that complaint directly to the sponsor.
