TERMS AND CONDITIONS

  

ARTICLE 1: ORGANIZING COMPANY

Westfield Europe Limited (hereinafter "the Organizer"), is organizing a free contest with no obligation to purchase entitled " Step Counter Challenge " (hereinafter the "Game"), intended for members of the loyalty program, each month, in both Westfield London and Westfield Stratford City (each a "Shopping Centre" or the "Shopping Centres") and which will take place monthly on the dates mentioned in the Shopping Centre Application (hereinafter the "App").

ARTICLE 2: OPERATION OF THE GAME

The Game consists of taking the greatest number of steps during each month of the Game. The number of steps you take during the day is counted using an app (native for iOS or downloadable for Androids). At the end of the Game, each Shopping Centre will reward the member(s) who have counted the highest number of steps at that particular Shopping Centre.

ARTICLE 3: PARTICIPATING IN THE GAME

The Game is reserved for any citizen  in the UK, who is a member of the loyalty program (hereinafter the "Participant ").

 

You must:

  • Have a smartphone equipped with an app that allows you to count the number of steps. This app is native for iOS. For Androids, you will need to download the Health Connect app and sync it with the "Health" app of your choice. Apps that are compatible with Health Connect are compatible here ;
  • be a member of the Loyalty Program and log in to the App.

 

 

Participation in the Game is free of charge and there is no obligation to purchase.

 

A Participant will only be able to participate in one Game even if several Games are running at the same time in different Shopping Centres. A Participant will only be able to win once every three (3months per Shopping Centre.

 

Participation is strictly nominative and the Participant may not play under several pseudonyms or on behalf of other participants. The Organizer reserves the right to ask any Participant to justify these conditions. Any Participant who does not meet these conditions or refuses to justify them will be excluded from the Game and will not be able to benefit from the prize in the event of winning.

It is understood that a Participant is defined as a unique natural person: any use of different addresses for the same Participant would be considered an attempt at fraud resulting in the immediate elimination of the Participant and the eventual cancellation of winnings.

ARTICLE 3: TERMS AND CONDITIONS

The Game is accessible to Participants according to the dates defined by the Shopping Centre directly in the App.

To participate, the Participant must do the following:

  • Download the  App either via the QR code made available in the Shopping Centres or directly on the application download application on your phone;
  • Log in to your loyalty account with your username and password.

If the Participant does not have a loyalty account, he/she will be redirected to the registration form for the loyalty program of the Shopping Centre concerned. In this case, the Participant remains free to subscribe or not to the loyalty program. However, it is reminded that the Game is reserved for members of the loyalty program;

  • Access the Games in progress by going to the "Challenge" section;
  • Once in the "Challenge" section of the selected Shopping Centre, click on the button to participate in the Game and activate the application on your phone to count the number of steps.

From this activation, the steps you take during the day can be counted for the Game. In order for them to be taken into account for the Game, you must record in the App the number of steps you have taken in each day. Otherwise, the steps you have taken during the day will not be counted.

You also have the option to activate a bonus. If you have been identified in the Shopping Centre during the day (for example by scanning one of the QR codes available in the Shopping Centre), your daily step count will be automatically doubled.

Participation in the Game implies unreserved acceptance of these rules (hereinafter the "Rules"), in their entirety, as well as compliance with the legislation in force England and Wales (in particular, the laws relating to information technology, freedoms, respect for good morals, literary and artistic property).

Participation in the Game implies a loyal, responsible and dignified attitude, including respect for the rules of these Rules and the rights of other participants.

The Participant shall refrain from implementing or seeking to implement any participation process that does not comply with the principles of these Rules.

The winner of the Game at each Shopping Centre will be the Participant who takes the most steps during the period of time specified in the App (the “Winner”).

ARTICLE 4 : PRIZE

The prize is determined by each Shopping Centre and is therefore specified directly in the App.

The number of Winners is set by each Shopping Centre and is specified directly in the App. This number may change from Game to Game.

The prize won may not give rise to any negotiation of any kind on the part of the Winners, nor to the delivery of its equivalent value in money, nor to its replacement or exchange for any reason whatsoever.

In the event that a Winner does not wish or is unable, for any reason whatsoever, to benefit from all or part of the prize won under the conditions described in these Rules, he/she will be considered to have renounced the full benefit of the said prize and will not be able to claim any compensation or consideration from the Organizer in this respect.

ARTICLE 5: INFORMING THE WINNERS AND WITHDRAWING THE PRIZE

At the end of the Game, the Winner(s) will be informed by email at the address he/she provided when creating his/her account and must pick up his/her reward at the reception of the Shopping Centre in which he/she participated in the Game. The Winner(s) will be the member(s) who have logged the most steps during the Game. In the event of a tie between several Participants, the Winner(s) will be the one or those who have been detected/identified the most times in the Shopping Centre during the Game. If the tie persists, the Winner(s) will be the first to register to participate in the Game. If there is still a tie, the Winner(s) will be the one or those who signed up for the loyalty program first.

In order to collect his/her prize, the Winner(s) must go to the reception of the Shopping Centre from the day following receipt of the email informing them that he/she has/have won with their identity document.

They will have a maximum of 15 working days from the day they were notified to come and pick up their prize at the Centre's reception.

If the Winner does not pick up his/her prize within the time limit mentioned above, he/she loses the benefit of his/her prize, without the Organizer being held liable and without any indemnity or financial compensation.

A Participant will only be able to win one Game per Shopping Centre every three (3) months. Therefore, if one of the Winners of the Game has already won a challenge in the previous  (3) months in the said Shopping Centre, the Organizer will not award him a prize and the prize will be awarded to the next participant in the ranking.

ARTICLE 6: DISPUTES AND RESPONSIBILITIES

The Organizer cannot be held liable if, in the event of force majeure or justified necessity, it is required to cancel, shorten it, extend it or modify the conditions of this Game.

The Organizer may cancel or suspend all or part of the Game or exclude one of the Participants if it appears that fraud has occurred in any form whatsoever (excessive number of steps in relation to a day, falsification of the number of steps, etc.). In this case, it reserves the right not to award the Prizes to fraudsters, to remove them from the ranking and/or to prosecute the perpetrators of these frauds before the competent courts. They will receive an email to the email address provided by the Organizer informing them of the deletion of their participation.

In the event of incidents with the prize, the Organizer reserves the right to replace all or part of the prize with another prize of equivalent value. The Organizer cannot be held responsible for the use or trading of the prize by the Winner.

The Organizer declines all responsibility for any incidents and/or accidents that may occur during the period of enjoyment of the Prize awarded and/or as a result of its use and excludes all guarantees with regard to the Winner.

In the event of a dispute relating to the interpretation and execution of these Game Rules, the Organizer will seek an amicable solution to the dispute with the Participant(s). In the absence of an amicable settlement, any dispute falls under the jurisdiction of the courts.

ARTICLE 7: PERSONAL DATA

The personal data collected in the context of the Contest is exclusively intended for the Organizer and any company of the Unibail Rodamco Westfield Group and will be processed in accordance with the provisions applicable to the protection of personal data and in particular those of EU Regulation 2016/679 of 27 April 2016 (hereinafter the "GDPR").

 

  • As part of the Game, the following Participants' personal data will be collected:
    • Name;
    • Forename;
    • Email address (hereinafter referred to as "Personal Data ").

     

  • The data controllers will be:
    • The Organizer;
    • Unibail Management, a simplified joint-stock company with a capital of €20,000,000, whose registered office is located at 7 place du Chancelier Adenauer 75016 Paris, registered with the Paris Trade and Companies Register under number 414 878 389.

     

  • Personal Data will be collected, stored, accessed and processed:
    • To enroll in the loyalty program;
    • For the participation of Participants in the Game;
    • For the designation of the Winner(s).

     

  • The legal basis for this processing is the performance of a contract, this Regulation.

     

  • Personal Data will not be transferred outside the European Union. No profiling will be carried out.

 

The following will be the recipient of the Participants' Personal Data:

  • The Organizer (including the staff of the Shopping Centres);
  • 21 Factory to allow the identification of Participants via the QR code.

    Participants' Personal Data will be kept for the duration of the Game, plus two (2) months.

     

    The Personal Data collected is mandatory to participate in the Game. Consequently, the Participant who exercises the right to delete his/her Personal Data before the end of the Contest will be deemed to renounce his/her participation.

     

    Under the GDPR, Participants and Winners have the following rights:

  • Access their Personal Data, in particular to verify its accuracy and completeness;
  • Request rectification of their Personal Data;
  • Object to or request a restriction of the processing of their Personal Data;
  • Request the portability of Personal Data;
  • -- Instruct on the processing of their Personal Data after their death.

ARTICLE 8: EVIDENCE

It is agreed that the Organizer may rely, in particular for the purpose of proof of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of any kind or in any computer or electronic formats or media, established, received or stored directly or indirectly by the Organizer, especially in its information systems.

The elements considered constitute evidence and, if they are produced as evidence by the Organizer in any contentious or other proceedings, they will be admissible, valid and enforceable in the same way, under the same conditions and with the same probative value as any document that is drawn up, received or kept in writing.

 

ARTICLE 9: COMMUNICATION OF THE RULES OF THE GAME

The full Rules of the Game are accessible directly in the App.

The Rules of the Game may also be sent, free of charge, to any person who makes a written request by post to the address of the Organizer stipulated in Article 1 of these Rules.

Any modification or interruption of the Game or modification of these Rules will be the subject of an amendment that will be published directly in the App.

Any complaint must be the subject of a written request to the attention of the Organizer at the email address following in Article 1 of these rules.

The Promoter reserves the right, at its sole discretion, to respond or not to any correspondence relating to the Game.

ARTICLE 10 :GOVERNING LAW

The Game and the interpretation of these Rules are subject to English law, without prejudice to the public policy provisions applicable in the country of residence of the Participant.

Any dispute arising in connection with the Game, which is not settled by an alternative dispute resolution method, will be submitted to the competent English courts.
