WESTFIELD “WESTFIELD GOOD FESTIVAL” 2024

TERMS OF USE

1             MEANINGS AND INTRODUCTION

PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY AFFECT YOUR RIGHTS AND LIABILITIES UNDER THE LAW AND SET OUT THE TERMS UNDER WHICH WESTFIELD EUROPE LIMITED (“WESTFIELD”) MAKES THE WESTFIELD GOOD FESTIVAL EVENT (THE “EVENT”) AVAILABLE FOR USE.  BY ATTENDING THE EVENT YOU ARE DEEMED TO HAVE ACCEPTED AND AGREE TO ADHERE TO THESE TERMS OF USE.

1.1.        Please note, subject to these Terms, use of or participation in any of the activities at the Event are undertaken entirely at your own risk.

1.2.        All children under the age of 16 must be accompanied and supervised by a parent or guardian at all times whilst attending the Event.

1.3.        The Event is free of charge to all attendees, however some Event activities (“Activities”) are charged at £5. These proceeds will go to our charity partner Traid, Unit G10, Clerkenwell Workshops, 27/31 Clerkenwell Close, London, EC1R 0AT with registered charity number 297489 (minus fees and VAT where applicable). .

1.4.        The Activities that require a ticket are bookable via our ticket provider Eventbrite.

1.5.        We reserve the right to refuse admittance to attendees arriving ten (10) minutes after the commencement of the Activity, however the Event staff will try to accommodate latecomers where possible.

1.6.        If we can admit latecomers, you will be directed to the most accessible space. This may not be your pre-booked space.

1.7.        A limited number of walk-in tickets may be available for the Activities. Walk-in tickets are provided on a first come, first served basis, whilst availability lasts.

1.8.        Westfield reserves the right to refuse admission to the Event for any reason, including for health and safety or for licensing reasons.

1.9.        Westfield reserves the right to request attendees to leave the Event or the Westfield shopping centre at any time and may take appropriate action to enforce this right. For example, Westfield may refuse access to or may remove attendees from the Event or Westfield shopping centre who:

1.9.1.     have been convicted of a criminal offence which, in the opinion of Westfield, is likely to affect the safety or enjoyment of other visitors;

1.9.2.     have behaved in a manner which is likely to affect the safety or enjoyment of other visitors;

1.9.3.     have used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages or threatens to damage any part of the Event, Activities or exhibits, or any part of the property at the Westfield shopping centre; or

1.9.4.     in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.

1.10.      All attendees must adhere to the general rules of use as displayed at the Event.

 

2             HEALTH AND SAFETY

2.1         Westfield may carry out security searches from time to time to ensure the safety or all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken to the Event and/or the Westfield shopping centre.

2.2         You may not take any weapons, glass bottles, flammable liquids or any other item that Westfield in its sole discretion may consider is dangerous to the Event and/or the Westfield shopping centre.

2.3         No food or drink is permitted into the Event or Activities.

2.4         You will comply will all relevant safety announcements and regulations while attending the Event including but not limited to using the hand sanitation stations upon entry to the Event and the Westfield shopping centre.

 

3             SPECIFIC TERMS RELATING TO THE ACTIVITIES

3.1         Some activities have age restrictions and such age restrictions should be checked at the time of booking and adhered to.

3.2         Personal protective equipment will be provided by Westfield for some activities (including gloves and aprons).

 

3.3         ARTS AND CRAFTS EXPERIENCE – To participate in ‘Sock Monster Workshop’ you must adhere to the rules below:

3.3.1      Attendees must be aged 12 years old and under;

3.3.2      There may only be a maximum of 16 children per each 30-minute session;

3.3.3      Each child must be accompanied by one adult;

3.3.4      Children must never be left unattended at the Activity;

3.3.5      This Activity is provided on a ticket and drop-in basis. Drop-in spaces are allocated on a first come, first served basis;

3.3.6      The opening hours for the Activity will vary for as long as arts and crafts stocks last;

3.3.7      Each child is only permitted to participate in one arts and crafts session per day; and

3.3.8      Each child is only permitted to make one craft item per day.

4             OPENING HOURS AND AVAILABILITY

4.1         Westfield reserves the right, in its absolute discretion, whether for safety reasons or otherwise, to close the Event. Westfield will, where possible, give prior notice of such closure.

4.2         The opening hours of each Activity may vary depending on availability, and queue lines may close early in order to ensure those waiting do get their turn.

5             LIMITATION OF LIABILITY

5.1         Whilst Westfield makes every effort to monitor the Event fulfilled by the suppliers of the Event (“Event Suppliers”), any liability incurred by you, or a visitor caused by the Event Supplier’s negligence is the responsibility of the Event Supplier and not the responsibility of Westfield.  Westfield shall not be liable for the death or personal injury of you, a visitor or third party while attending the Event provided by the Event Supplier. Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against Westfield and the shopping centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your attendance at the Event.

5.2         Due to the nature of some of the experiences offered by the Event Supplier including the creation of beauty items, certain ingredients  may be harmful to your health. Therefore, as a participant and/or visitor, or you as a parent or guardian must notify the Event organiser present at the Event of any medical conditions or allergens before participating.

5.3         Nothing in these terms and conditions affects your statutory rights.

5.4         Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses. 

5.5         Westfield does not accept responsibility for (i) network, computer, hardware or software failures of any kind which may restrict or delay the purchase or delivery of items, or (ii) any act or default of any third-party supplier which is outside of Westfield’s reasonable control. 

5.6         Except as set out in paragraph 5.1 above, nothing in the Terms shall exclude or restrict Westfield’s or the shopping centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.

6             IN GENERAL

6.1         We reserve the right to refuse admission to the Event in reasonable circumstances including for health and safety reasons, licensing reasons or inappropriate behaviour We reserve the right to request that you leave the Event and/or the Westfield shopping centre at any time in our absolute discretion.

6.2         Save that any company in the Westfield group of companies, as well as the Westfield shopping centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

6.3         Nothing in these Terms affects any of your statutory rights which may not be legally excluded.

6.4         Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.

6.5         These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and any disputes will be decided only by the exclusive jurisdiction of the English courts.

 

WESTFIELD GOOD FESTIVAL -TICKET TERMS & CONDITIONS

1             MEANINGS AND INTRODUCTION

1.1         Please read these terms and conditions (the “Ticketing Terms”) carefully as they affect your rights and liabilities.

1.2         Westfield Europe Limited (“Westfield”, “we”, “us” or “our”) sell, allocate and issue tickets (the “Ticket(s)”) for the Westfield Good Festival (the “Event”) at Westfield London and Westfield Stratford City (each a “Centre”, together the “Centres”) on these terms and the Event terms and conditions of use (the Event terms and conditions of use and these ticketing terms, together the “Terms”) published by us from time to time. By purchasing, booking or being issued with Ticket(s), all recipients of Ticket(s) (“you”) including the original buyer and booker (the “Buyer”) are deemed to have accepted and agree to adhere to the Terms. Westfield reserves the rights to amend these Terms from time to time.

1.3         The Terms are additional to and not a substitute for the general terms and conditions of use of our website which can be found at https://www.westfield.com/en-gb/terms-and-conditions

1.4         The Ticket(s) are for personal use. You must not auction, donate, offer for sale, or advertise Ticket(s) for sale via the internet or elsewhere without our prior written consent.

1.5         A valid Ticket must be booked and produced for each person wishing to take part in the event.

1.6         A Ticket(s) obtained in breach of the Terms, or which in our reasonable opinion is being used or is intended to be used in breach of the Terms, shall be void.  This may include you being refused entry to the Event, or the Ticket(s) being cancelled, without notification. No compensation will be provided in such circumstances and we reserve the right to withhold any refund.

1.7         You must not use Ticket(s) as prizes in promotions, sweepstakes, hospitality packages, auctions, lotteries or competitions (including those used for charity) without our prior written consent.

2             BOOKING

2.1         This is a Ticket only Event.

2.2         All children aged under 16 years old must be accompanied by an adult at all times during the Event.  

2.3         Ticket(s) must be bought or obtained directly from us via our ticketing provider, Eventbrite, website Eventbrite. We reserve the right to refuse to sell or distribute Ticket(s) to individuals, companies or agencies who we suspect have breached, or intend to breach, the Terms.

2.4         The Buyer must acknowledge and accept these Terms and any other documentation that forms part of the Ticket booking.

2.5         When you book Ticket(s) online and confirm your order by pressing the ‘Confirm order’ button, you are making an offer to us to purchase the Ticket(s) on the terms set out in your order. No order will be accepted until we have received full payment in cleared funds following which your Ticket(s) will be booked and you will receive a confirmation of this by email, normally within 24 hours.

2.6         The Buyer is responsible for making sure the information in your order is correct before confirming the order for the Ticket(s). When you have confirmed your order, no details of your booking can be changed, other than your personal details. The Ticket(s) will only be valid for the time, day, item and Centre stated upon them. You understand that there are only a certain number of Ticket(s) and reservations available for each day and time slot at the Centre and so please ensure that you complete your booking to avoid disappointment.

2.7         For purchases we accept payment by credit or debit card. The proceeds of purchases will go to our charity partner Traid, Unit G10, Clerkenwell Workshops, 27/31 Clerkenwell Close, London, EC1R 0AT with registered charity number 297489 (minus fees and VAT where applicable).  All transactions are shown in pounds sterling and include VAT.

2.8         In addition to the price of your Ticket(s) you may be required to pay an international currency exchange fees which may apply. These fees are not refundable in any event.

2.9         Once you have completed your order for the Ticket(s) we will not accept any requests for changes to the details of your booking (except in exceptional circumstances where you should contact Customer Service - UK.Ticketing@westfield.com, so please be sure to check the confirmation page carefully before placing your order.

2.10       Westfield does not guarantee the availability of the website or the Event at any time. The prices applicable will be those on the website at the time of ordering (as appearing in your confirmation page) except in the case of manifest error.

3             DELIVERY AND COLLECTION

3.1         Upon booking your Ticket(s) and receiving the order confirmation, your Ticket(s) will be emailed to you via our ticketing provider, Eventbrite.

3.2         Always check your Ticket(s) upon receipt and let us know if there are any errors. Mistakes made when ordering cannot always be corrected and any corrections are discretionary.

4             REDEEMING YOUR TICKET AND RETURN OF FUNDS

4.1         On the day of your visit to the Event you should check that the Centre and the Event are open, check the event start time and bring your Ticket with you to the Event.

4.2         You should present and surrender your Ticket to a member of staff on arrival at the Event.

5             REPLACEMENT TICKETS 

5.1         Westfield is not responsible for any lost, stolen or damaged Ticket(s).  Any replacement of lost, damaged or stolen Ticket(s) is at our discretion and we may charge an administration charge for the replacement. 

6             REFUND POLICY

6.1         We do not refund Ticket(s) prior to the Event except in certain circumstances.

6.2         If the Event is closed for any reason for the whole of the time slot during which your Ticket(s) is valid, then the original Buyer of the Ticket(s) will be issued with a refund for the value of the amount that they paid for the Ticket(s). The maximum refund payable will be the face value of the Ticket(s).  Westfield will not be responsible in any circumstances for any travel costs incurred.

6.3         Only the original Buyer of the Ticket(s) is eligible for refunds.

6.4         Non-attendees will not be eligible for refunds unless they have cancelled their Ticket(s) in advance as described in paragraph 6.5 below. Applications for refunds will only be accepted if received within 28 days of the date on the Ticket.

6.5         Requests to cancel Ticket(s) must be made no later than 24 hours before your booked attendance slot.  If you wish to cancel please send an application for a refund as described below. 

6.6         Westfield reserves the right to change the advertised dates, opening hours and schedule of the Event without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may close or remove session at the Event if deemed faulty or unsafe. These Terms set out your rights in this situation.

6.7         Notwithstanding the foregoing, Westfield reserves the right to cancel the Event for any reason at any time without notice or liability.

6.8         Any applications for refunds should be sent to Customer Service - UK.Ticketing@westfield.com.  Each application for a refund must state your booking reference, name of the original Buyer (and the email address registered with your booking) and the reason for your application.

7             HEALTH AND SAFETY

7.4         Smoking is strictly prohibited in the Event and the Centre for health and safety reasons.

8.1         Whilst Westfield makes every effort to monitor the Event fulfilled by the suppliers of the Event (“Event Suppliers”), any liability incurred by you, the Buyer or visitor caused by the Event Supplier’s negligence is the responsibility of the Event Supplier and not the responsibility of Westfield.  Westfield shall not be liable for the death or personal injury of you, the Buyer, visitor or third party while attending the Event provided by the Event Supplier. Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. 9             IN GENERAL

9.1         Any discounts, vouchers or lower priced Ticket(s) must be mentioned when you buy Ticket(s) and cannot be applied for in retrospect. Where a discount, voucher or lower price is claimed, proof of identity and entitlement may be required.

9.2         Possession of a Ticket does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Ticket(s).

9.3         We reserve the right to change the advertised dates, opening hours and schedule of the Event without notice or liability, where it is necessary to do so for reasons beyond our reasonable control. We may close or remove parts of the Event if deemed faulty or unsafe. These Terms set out your rights in this situation.

9.4         We reserve the right to change the Terms from time to time.

9.5         We reserve the right to refuse admission to the Event in reasonable circumstances including for health and safety reasons, licensing reasons, inappropriate behaviour or where a Ticket(s) is invalid for any reason. We reserve the right to request that you leave the Event and/or Centre at any time in our absolute discretion.

9.6         We reserve the right to change the Terms from time to time.

9.7         Save that any company in the Westfield group of companies, as well as the Centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

10           HOW WE USE YOUR PERSONAL DATA

10.1       By purchasing a Ticket and/or attending the Event, you are sending your personal information to Westfield who will use this personal data in accordance with data protection laws. Further information on how personal data is used, and data protection rights are explained in Westfield’s Privacy Notice, available at https://uk.westfield.com/privacy. Westfield’s data protection team can be contacted at dpo@urw.com. Entrants wishing to exercise their rights can do so by submitting a form at MyRights. 

10.2       You will also be providing personal data to our ticketing partner, Eventbrite, and will be processed in accordance with their privacy notice.

10.3       Where you have consented to receiving marketing materials from our ticket provider Eventbrite, you understand that your personal data will be treated in accordance with the Eventbrite’s privacy notice (not Westfield’s) and that it is Eventbrite who is responsible for ensuring that your personal data is treated in accordance with data protection laws.  Should you have any queries or complaints in relation to Eventbrite’s treatment of your personal data, you should refer that complaint directly to Eventbrite.
