TERMS OF ENTRY AND USE
1 MEANINGS AND INTRODUCTION
PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY AFFECT YOUR RIGHTS AND LIABILITIES UNDER THE LAW AND SET OUT THE TERMS UNDER WHICH UNIVERSAL PICTURES INTERNATIONAL UK & EIRE LIMITED (“UNIVERSAL”) AND WESTFIELD EUROPE LIMITED (“WESTFIELD”) MAKE THE “WICKED: FOR GOOD – THE EXPERIENCE”, THE “WICKED: FOR GOOD TREE” AND “WICKED: FOR GOOD YELLOW BRICK ROAD RETAIL TRAIL” (THE “EVENT”) AVAILABLE FOR USE. BY ATTENDING THE EVENT YOU ARE DEEMED TO HAVE ACCEPTED AND AGREE TO ADHERE TO THESE TERMS OF USE.
Please note, subject to these Terms, use of or participation in any of the activities at the Event are undertaken entirely at your own risk.
All children under the age of 16 must be accompanied and supervised by a parent or guardian at all times whilst attending the Event.
The Event activities (“Activities”) are free of charge to all attendees but note:
WICKED: FOR GOOD – THE EXPERIENCE requires you to pre-book a ticketed timeslot; and
Digital participation in WICKED: FOR GOOD YELLOW BRICK ROAD RETAIL TRAIL requires downloading and use of the Westfield App(internet or broadband connection is required to download the App. If you choose to submit your entry via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities and the terms and conditions of the App).
Wicked: For Good – The Experience ticket are bookable via Westfield’s website https://www.westfield.com/en/united-kingdom/london/wicked-for-good-the-experience. Timeslots are limited.
We reserve the right to refuse admittance to attendees arriving ten (10) minutes after the commencement of the Activity, however the Event staff will try to accommodate latecomers where possible.
If we can admit latecomers, you will be directed to the most accessible space. This may not be your pre-booked space.
Booking is not required for the Wicked: For Good Tree or Yellow Brick Road Retail trail.
Universal and/or Westfield reserve the right to refuse admission to the Event for any reason, including for health and safety or for licensing reasons.
Universal and/or Westfield reserve the right to request attendees to leave the Event or the Westfield shopping centre at any time and may take appropriate action to enforce this right. For example, Universal and/or Westfield may refuse access to or may remove attendees from the Event (or in the case of Westfield, the Westfield shopping centre) who:
have been convicted of a criminal offence which, in the opinion of Universal and/or Westfield, is likely to affect the safety or enjoyment of other visitors;
have behaved in a manner which is likely to affect the safety or enjoyment of other visitors;
have used threatening, abusive or insulting words or behaviour or behaves in a manner which may provoke a breach of the peace, or deliberately damages or threatens to damage any part of the Event, Activities or exhibits, or any part of the property at the Westfield shopping centre; or
in the reasonable opinion of Universal and/or Westfield is acting under the influence of alcohol or drugs.
All attendees must adhere to the general rules of use as displayed at the Event.
HEALTH AND SAFETY
Universal and/or Westfield may carry out security searches from time to time to ensure the safety of all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken to the Event and/or the Westfield shopping centre.
The following items will be prohibited from the Event:
weapons, bladed/sharp articles, ammunition, explosives, horns, whistles, drums, fireworks, flags, flagpoles, inflatables, large umbrellas, glass bottles, flammable liquids in any container, laser pens, illegal drugs, alcoholic beverages, animals (subject to clause 2.6), confetti, glitter bombs, balloons, wheeled footwear, helmets, full face masks, or any other item which in our reasonable opinion, may cause danger or disruption (regardless of whether or not such item is illegal or is carried for specific purposes).
No food or drink is permitted into the Event or Activities.
You will comply with all relevant safety announcements and regulations while attending the Event.
No smoking is permitted at the Event or in the Event area including electronic cigarettes/vaping.
You are not permitted to bring animals to the Event area with the exception of guide, assistance and hearing dogs.
If you have any specific access requirements, please contact a member of event staff on arrival.
specific terms relating to THE activities
YELLOW BRICK ROAD RETAIL TRAIL:
Digital participation in the YELLOW BRICK ROAD RETAIL TRAIL requires you to download the Westfield App. The App is free, but your wireless service provider may charge you for data used. Westfield’s terms and conditions of the use of the App will apply. As an alternative, paper maps are available from Westfield guest services.
For participants who complete the paper trail only: A free Wicked: For Good film poster can be claimed at Westfield guest services while stock lasts.
For participants who complete the digital trail only: There will be a chance, via the Westfield App, to enter to win a family treehouse adventure in Snowdonia. WICKED: FOR GOOD – THE EXPERIENCE and the WICKED: FOR GOOD TREE:
Some Activities in WICKED: FOR GOOD – THE EXPERIENCE and the WICKED: FOR GOOD TREE have items at height which you can sit on to take photos, but the sets can still be explored and enjoyed if you unable to participate in this element.
One activity in WICKED: FOR GOOD – THE EXPERIENCE, contains the 3D sculpture of a monkey. It is not real and does not move but may be scary to younger guests or those who have a phobia of these animals.
WICKED: FOR GOOD – THE EXPERIENCE and THE WICKED: FOR GOOD TREE use subtle sound and lighting effects.
Some areas of WICKED: FOR GOOD – THE EXPERIENCE will have smells delivered by Lush.
Opening Hours and Availability
Universal and/or Westfield reserve the right, in their absolute discretion, whether for safety reasons or otherwise, to close the Event. Universal and/or Westfield will, where possible, give prior notice of such closure.
The opening hours of each Activity may vary depending on availability, where relevant, queue lines may close early in order to ensure entry for those with prebooked tickets.
LIMITATION OF LIABILITY
Neither Westfield nor Universal Westfield shall be liable for the death or personal injury of you, a visitor or third party while attending the Event. Neither Universal nor Westfield shall have any liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against Universal and Westfield and the shopping centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your attendance at the Event.
Nothing in these terms and conditions affects your statutory rights.
Neither Westfield nor Universal shall be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.
Neither Westfield nor Universal accept responsibility for (i) network, computer, hardware or software failures of any kind which may restrict or delay the download or completion of items, or (ii) any act or default of any third-party supplier which is outside of Westfield’s or Universal’s reasonable control.
Except as set out in paragraph 5.1 above, nothing in the Terms shall exclude or restrict Universal’s or Westfield’s or the shopping centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.
In general
We reserve the right to refuse admission to the Event in reasonable circumstances including for health and safety reasons, licensing reasons or inappropriate behaviour We reserve the right to request that you leave the Event and/or the Westfield shopping centre at any time in our absolute discretion.
Save that any company in the Universal and/or Westfield group of companies, as well as the Westfield shopping centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
Nothing in these Terms affects any of your statutory rights which may not be legally excluded.
Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and any disputes will be decided only by the exclusive jurisdiction of the English courts.
