ATTENDEE TERMS AND CONDITIONS
Meanings and introduction
Please read these ATTENDEE Terms AND CONDITIONS (the “terms”) carefully as they affect your rights and liabilities under the law and set out the terms under which Westfield Europe Limited (“Westfield”) makes the Westfield FEEL THE FREQUENCY Event (The “event”) available for ATTENDANCE. By ATTENDING THE Event you are deemed to have accepted and agree to adhere to these Terms of Use.
Please note, subject to these Terms, use of or participation in any of the activities at the Event are undertaken entirely at your own risk.
All attendees must be aged 16 or over.
The Event activities (“Activities”) are free of charge to all attendees
The Activities that require a ticket is booked via our ticket provider Omnilab.
We reserve the right to refuse admittance to attendees arriving ten (10) minutes after the commencement of the relevant Activity which has been booked, however the Event staff will try to accommodate latecomers where possible.
If we can admit latecomers, you will be directed to the most accessible space. This may not be your pre-booked space.
A limited number of walk-in tickets may be available for the Activities. Walk-in tickets are provided on a first come, first served basis, whilst availability lasts.
Westfield reserves the right to refuse admission to the Event for any reason, including for health and safety or for licensing reasons.
Westfield reserves the right to request attendees to leave the Event or the Westfield shopping centre at any time and may take appropriate action to enforce this right. For example, Westfield may refuse access to or may remove attendees from the Event or Westfield shopping centre who:
has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;
has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages or threatens to damage any part of the Event, Activities or exhibits, or any part of the property at the Westfield London shopping centre; or
in the reasonable opinion of Westfield is acting under the influence of alcohol or drugs.
All attendees must adhere to the general rules of use as displayed at the Event.
HEALTH AND SAFETY
Westfield may carry out security searches from time to time to ensure the safety or all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken to the Event and/or the Westfield shopping centre.
You may not take any weapons, glass bottles, flammable liquids or any other item that Westfield in its sole discretion may consider is dangerous to the Event and/or the Westfield shopping centre.
No food or drink is permitted into the Event or Activities.
You will comply with all relevant safety announcements and regulations while attending the Event including but not limited to using the hand sanitation stations upon entry to the Event and the Westfield shopping centre.
SPECIFIC TERMS RELATING TO THE ACTIVITIES
Some Activities have age restrictions and such age restrictions should be checked at the time of booking and adhered to.
OPENING HOURS AND AVAILABILITY
Westfield reserves the right, in its absolute discretion, whether for safety reasons or otherwise, to close the Event. Westfield will, where possible, give prior notice of such closure.
The opening hours of each Activity may vary depending on availability, and queue lines may close early in order to ensure those waiting do get their turn.
LIMITATION OF LIABILITY
Whilst Westfield makes every effort to monitor the Event fulfilled by the suppliers of the Event (“Event Suppliers”), any liability incurred by you, or a visitor caused by the Event Supplier’s negligence is the responsibility of the Event Supplier and not the responsibility of Westfield. Westfield shall not be liable for the death or personal injury of you, a visitor or third party while attending the Event provided by the Event Supplier to the extent permitted by law. Westfield shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against Westfield and the shopping centre owner and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your attendance at the Event to the extent permitted by law.
Nothing in these terms and conditions affects your statutory rights.
Westfield shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.
Westfield does not accept responsibility for (i) network, computer, hardware or software failures of any kind which may restrict or delay the purchase or delivery of items, or (ii) any act or default of any third-party supplier which is outside of Westfield’s reasonable control.
Nothing in these Terms shall exclude or restrict Westfield’s or the shopping centre owner’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.
IN GENERAL
We reserve the right to refuse admission to the Event in reasonable circumstances including for health and safety reasons, licensing reasons or inappropriate behaviour We reserve the right to request that you leave the Event and/or the Westfield shopping centre at any time in our absolute discretion.
Save that any company in the Westfield group of companies, as well as the Westfield shopping centre owners, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
Nothing in these Terms affects any of your statutory rights which may not be legally excluded.
Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and any disputes will be decided only by the exclusive jurisdiction of the English courts.
